1. Acceptance of Terms

These Terms of Service ("Terms") govern your access to and use of JustTCG ("the Service"), operated by JustTCG LLC ("we", "our", or "us").

2. Description of Service

JustTCG provides pricing data and related information for trading card games. The Service is offered through our website, API, and associated applications.

3. Service Availability and "As-Is" Provision

The Service is provided on an "as is" and "as available" basis. JustTCG does not guarantee that the Service will be uninterrupted, timely, secure, or error-free.

No Refunds for Service Interruptions: We do not provide refunds for temporary service interruptions, outages, or technical issues. Subscription fees are non-refundable except as expressly stated in these Terms or where required by applicable law.

4. User Accounts

To access certain features of the Service, you may be required to create an account. Each person is only entitled to one account. Creating or maintaining multiple accounts for the same individual is strictly prohibited and may result in suspension or termination of all related accounts.

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

5. API Usage and Rate Limits

The Service includes rate limits based on your subscription tier. Exceeding these limits may result in temporary suspension of API access or additional charges. You agree not to attempt to circumvent these limits or engage in activities that could disrupt or negatively impact the Service.

6. Prohibited Uses

You agree not to use the Service for any unlawful purpose or in any way that violates these Terms. Specifically, you agree not to:

Engage in automated account creation, including the use of bots or scripts to create multiple accounts or abuse the free tier.
Use the free tier for commercial, business, scraping, or reselling purposes; the free tier is intended solely for personal, non-commercial use.
Share your account credentials with multiple individuals or entities. Each account is intended for use by a single individual.
Use the Service or the data provided through it to build, train, or operate a pricing API, data feed, or other product that serves as a substitute for the Service. Analytics and market observations derived for your own product are permitted on paid tiers as described in Section 7.
Attempt to bypass, circumvent, or interfere with any API rate limits, quotas, or other technical restrictions imposed by us.
Engage in any activity that could damage, disable, overburden, or impair the Service, or interfere with any other party's use of the Service.

7. Data Usage and Licensing

The data provided through the Service is licensed, not sold, to you. Subject to your continued compliance with these Terms, we grant you a non-exclusive, non-transferable, revocable license to use the data for your own business or personal purposes in accordance with your subscription tier.

7.1 Permitted Commercial Use (Paid Subscription Tiers)

If you hold an active paid subscription, you may:

End-user display: Display current prices, historical trends, and percentage changes to end users within a consumer-facing application or website.
Derived analytics: Calculate and display derived metrics, market observations, and aggregate valuations based on data obtained from the Service.
Caching and storage: Cache API responses server-side and store historical price points for as long as your subscription remains active, strictly to support features, logic, and user histories within your own application.
Data combination: Combine data obtained from the Service with other lawfully obtained market data sources.

The free tier is limited to personal, non-commercial use as described in Section 6 and does not carry the rights granted in this Section 7.1.

7.2 Scope of Stored Data

We do not impose a maximum retention period on data stored under Section 7.1. That storage right is purpose-bound: stored data may be used only to operate your own application, and may not be exported, published, sold, or otherwise made available to third parties as a dataset, whether in whole or in part. The license to use stored data terminates when your subscription ends or these Terms are terminated, and you may not thereafter use the accumulated data to provide a service to others.

7.3 Prohibited Uses (All Tiers)

Resell, redistribute, sub-license, or repackage the raw data or API access as a standalone data feed or bulk dataset.
Build, train, or operate a pricing API or other product that serves as a substitute for or competitor to the Service.
Use the data in a manner that violates applicable laws or regulations.
Remove, alter, or obscure any proprietary notices or attributions.
Use the Service for any illegal or unauthorized purpose.

7.4 Attribution

Attribution to JustTCG is appreciated but not required for internal or commercial use on paid tiers. See our Commercial Use Guidelines for plain-English guidance and suggested attribution wording. Those guidelines are explanatory only; in the event of any conflict, these Terms control.

8. Intellectual Property

All intellectual property rights in and to the Service, including but not limited to software, designs, text, graphics, and data compilations, are owned by JustTCG or its licensors. Nothing in these Terms grants you a right or license to use any trademark, design right, or copyright owned by JustTCG.

9. Subscription and Billing

The Service offers various subscription tiers with different pricing and features. By subscribing, you agree to pay all fees applicable to your subscription tier. Fees are non-refundable except as expressly stated in these Terms or where required by applicable law.

We may change the fees for the Service with 30 days notice. If you do not agree with a price change, you may cancel your subscription before the price change takes effect.

10. Termination

We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms.

We also reserve the right to suspend, limit, or terminate free tier accounts at our sole discretion, especially in cases of abuse, excessive usage, or violation of these Terms.

You may terminate your subscription at any time by following the instructions on the Service. Cancellation will take effect at the end of your current billing period.

11. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall JustTCG, its directors, employees, partners, agents, suppliers, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

Your access to or use of or inability to access or use the Service
Any conduct or content of any third party on the Service
Any content obtained from the Service
Unauthorized access, use, or alteration of your transmissions or content

Our total liability to you for any claim arising from or relating to these Terms or your use of the Service shall not exceed the amount paid by you to us during the 12 months preceding the claim.

12. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance.

JustTCG does not warrant that the Service will function uninterrupted, secure, or available at any particular time or location. We do not warrant the accuracy, completeness, or timeliness of the data provided through the Service.

13. Indemnification

You agree to defend, indemnify, and hold harmless JustTCG and its licensors, affiliates, and their respective officers, directors, employees, contractors, agents, licensors, and suppliers from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Service.

14. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms shall be brought exclusively in the federal or state courts located in the United States.

15. Changes to Terms

We reserve the right to modify these Terms at any time. If we make material changes to these Terms, we will provide notice through the Service or by other means. Your continued use of the Service after the changes take effect constitutes your acceptance of the revised Terms.

16. General Provisions

These Terms constitute the entire agreement between you and JustTCG regarding the Service and supersede all prior agreements and understandings.

If any provision of these Terms is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall be enforced.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
